css=&#8221;.vc_custom_1789750915538{margin-bottom: 0px !important;}&#8221;]As Nottingham prepares for students coming back to its universities, we welcome the Faculty of Forensic and Legal Medicine (FFLM) <a href=\"https:\/\/fflm.ac.uk\/forensic-practitioners\/fflm-warns-student-unions-against-self-swab-rape-kits\/\">warning about self-swab \u2018rape kits\u2019<\/a>.\u00a0 Writing to Student Union Presidents and Officers, on 10 September, they warned that these kits can unintentionally cause harm and lead to false reassurance.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Issues with Self-Swabbing Kits<\/strong><\/h2>\n<p>The FFLM stand by their <a href=\"https:\/\/fflm.ac.uk\/wp-content\/uploads\/2024\/09\/Joint-Position-statement-on-forensic-self-swab-services-after-sexual-assault-or-rape-with-FAQ-10-09-2024-v3.pdf\">joint position statement<\/a> on self-swabbing kits, first made in September 2024, which outlines key issues and answers important questions on the subject.<\/p>\n<p>The faculty do not advocate the use of self-swabbing kits because:<\/p>\n<ul>\n<li>They do not provide the opportunity for holistic psychosexual, medical and forensic assessment of the individual<\/li>\n<li>There is no evidence base that they are of benefit from a mental health perspective<\/li>\n<li>The samples taken may not be admissible in any court process<\/li>\n<li>They do not promote safeguarding of the vulnerable people<\/li>\n<li>There is no evidence base that the availability of such kits will act as a deterrent to sexual violence<\/li>\n<\/ul>\n<p>They also highlight that the results from a \u2018self-taken\u2019 swab will have an impact on results from a subsequent FME and will affect any interpretation made by a forensic scientist.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Our Position<\/strong><\/h2>\n<p>We are concerned that self-swab \u201crape kits\u201d are being promoted to students and young people, without an independently established evidence base, appropriate clinical oversight or the forensic safeguards required for criminal justice processes to be effective.<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><strong>A swab cannot prove rape <\/strong>\u2013 While detected DNA <em>may <\/em>indicate the sexual contact took place, it cannot establish the absence of consent.\u00a0 A single swab taken in a non-forensic environment may not be admissible in a court environment and misses the wide range of other physical and forensic evidence available that could support an accusation.<\/li>\n<li><strong>There are better ways of taking and storing forensic evidence\u00a0<\/strong>&#8211; Sexual Assault Referrals Centres (SARCS) can take and store a range of evidence (with the survivor\u2019s consent) including swabs; blood, urine and toxicology samples; photos and other evidence; keeping it in a secure facility.\u00a0 This combination of evidence can be used if a survivor later decides to report to the police.<\/li>\n<li><strong>SARCs offer more than swabbing\u00a0<\/strong>\u2013 They can offer someone to talk to and get early emotional support.\u00a0 They can also treat injuries and provide access to related health care, including sexual health and emergency contraception.<\/li>\n<li><strong>Survivors often need trauma-informed support\u00a0<\/strong>\u2013 The impact of sexual violence can affect survivors in a myriad of ways, impacting relationships, their ability to work or take part in education.\u00a0 Access to counselling and support can change lives. \u00a0Being listened to and believed is vital to helping survivors move forward after sexual violence.<\/li>\n<li><strong>There is no evidence that self-swabbing acts as a deterrent\u00a0<\/strong>\u2013 as self-taken swabs may not be admissible in court, they are unlikely to act as a deterrent.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>We believe that education around consent, healthy relationships and wider social change are more likely to turn the tide on sexual violence.\u00a0 In Nottingham, these measures include mandatory consent training in universities for first year students, the <a href=\"https:\/\/safespacenotts.com\/\">Safe Space Notts<\/a> network, and work done in partnership with the <a href=\"https:\/\/nottssvss.org.uk\/consent-coalition\/\">Consent Coalition<\/a>.<\/p>\n<p><a href=\"https:\/\/rapecrisis.org.uk\/news\/rcew-comments-on-the-fflms-response-to-self-swab-rape-kits\/\">You can read Rape Crisis England and Wales Position Statement here.<\/a><\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Call to Action<\/strong><\/h2>\n<p>Survivors of sexual violence deserve access to support and choices that meet their needs where they are.\u00a0 We are asking everyone to be an active upstander by doing the following three actions:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Sharing this blog<\/li>\n<li>Saving the details of three support services to your phone<\/li>\n<li>Saving the Safe Space Pledge to your phone home-screen, so it&#8217;s there if you need it<\/li>\n<li>Follow @ConsentInNotts on Facebook and Instagram for safe and health messages on consent<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Support for Survivors<\/strong><\/h2>\n<p>In Nottingham\/Nottinghamshire, all survivors \u2013 no matter who or where they are \u2013 can access <strong>free, quality-assured and confidential support<\/strong> after rape or sexual abuse.
